Common Violations
Here are some common violations of the
ADA for which businesses and commercial property owners get
sued. Most of them could be avoided at little or no cost.
Remember that a disabled person does not have to enter your
store to have their rights violated. You may never see the
person who files a law suit against you.
Parking lot violations (#1 cause of
lawsuits)
- Missing or improper signage
identifying Accessible parking
- Improper, worn or poorly stripped
parking lots
- Rough surfaces
Entrances
- Improper door handles
- Improper door opening width
- Too much force required to open
doors
- Inadequate landings
- Steps or other barriers
- Missing or improper signs
- Obstacles protruding into walkways
(signs, merchandise)
Isles and Counters
- Improper isle width (36"min)
- Lack of turning radius
- Clutter or merchandise in isles
- Check-out or register counter
height
- Inaccessible tables for eating or
working
Bathrooms
- Faucets must be operable
with one closed fist
- Toilet and sink height
- Improperly installed or
missing Grab bars
- Paper towel, soap
dispenser, mirror, toilet paper too high
- Enclosed vanities under
sink
- Exposed plumbing
under sink
